The relationship between lawyer and client is a fiduciary one in which the lawyer occupies the highest position of trust and confidence. The relationship is almost always unequal; thus, a sexual relationship between lawyer and client can involve unfair exploitation of the lawyer's fiduciary role, in violation of the lawyer's basic ethical obligation not to use the trust of the client to the client's disadvantage.
Damnit. As if my sex life needed added limitations.

Quiz Time
What? Am I a Republican? Why did I even bother taken this test?! I guess I’ll back to my George W. Bush fan club and tell them I just wasted 10 minutes of my life. At least I don’t stink, man.
Probably the most accurate quiz I've taken online.
The MPRE
So the MPRE is this coming Friday. I had the week leading up to it, from yesterday on, planned out for studying and passing the thing. So on day 2 of this 7 day plan I find myself already behind. I guess that's what we would call "not good." But really, who takes 6 days to study for the MPRE? Well not me.
Anyway, I have a feeling this is going to be a lot like the Legal Research exam I took first semester of 1L. Which would be a really good thing.

Not that that's a mitigating factor or anything, I'm just saying.
Watching Al Roker
When really fat people decide to lose a lot of weight, they should be mindful that they may end up with a disproportionate head. Mr. Roker looks like a freakin' living caricature or like a bobblehead doll when he nods.
Relationship Question #3
In an effort to help me out, Shell tries to clear up the mystery of women. Eh. I never really believed in any of the myths she dispels. Most of them are just over-generalizations that do apply to some women and men but definitely not all of them or even most - except for that height one.
Here's what I think the problem is: Both women and men keep an eye out for something better and will jump at the opportunity for something better when given the chance.
Now my theory is more nuanced than that much like Sen. Kerry's position on... well... everything. But for now I'll leave it at that. So do you agree or disagree?

Tough To See Him Go My Ass
She was trying to pawn that little fucker on any willing schmuck this passed Saturday. Apparently, all the alcohol on the ping-pong table worked and she was able to get someone drunk enough convinced to take the dog away. In fact, now that I reflect on it, I'm pretty sure the motivation for the get together she threw that night was to gather all the schmucks and pawn the little fucker off on an unsuspecting one.

SWLAW Way Behind In The Game
The NY Times has an article on how law schools try to manipulate the U.S. News & World Report rankings.
So is SWLAW playing the game poorly, not playing the game at all, or playing the game well but way overmatched?
Critics say law schools are engaged in an LSAT and G.P.A. arms race in which they exploit technicalities in U.S. News's methodology. Admissions people know, for example, that the rankings are calculated using grades and scores of only full-time students.
Rutgers School of Law, Camden, for example, has been shrinking its full-time program and increasing its part-time division for the last seven years. About 60 first-year students - many with less competitive LSAT's or grades - take one course in the summer to ease their load in the fall. By taking a three-quarters schedule, the students are considered part time. The school has moved up from No. 78 in 2003 to 65 this year.
It's not so much gaming the rankings as pressure to play the game, say many deans. "You distort your policies to preserve your ranking, that's the problem," says Mr. Kramer of Stanford. "These rankings are corrosive to the actual education mean because this poll takes the following 12 criteria and now you have to fetishize them."
So is SWLAW playing the game poorly, not playing the game at all, or playing the game well but way overmatched?

Still Scheduling Next Year
Well I finally got into Civil Practice with Prof. Parrish after having been put on the waitlist. I have a feeling thought that this is a "be careful what you wish for" situation. I'm expecting that that class is going to be a lot of work but with Prof. Parrish, I know that I'll at least learn something.
Also, I'm thinking about dropping out of ADR and switching to Immigration Law for the fall. It would save me a day at school and I think I could find some work in immigration after school. But ADR is kind of like the new trend for the way disputes are resolved so that class might be useful.

Someone To Root For
I was asked whether one of the contestants on The Law Firm is an alum of SWLAW and sure enough a check of the bios revealed that this guy is a Bison. He did the closing argument in this case and I thought he did a good job. But Roy Black thought he should have argued for punitive damages.
Anyway, the show reminds me a bit about ITAP tryouts and truthfully, a couple of the performances probably wouldn't have gotten those lawyers on SWLAW's ITAP. And with that, I take heart that I may actually be decent at this whole practicing law thingie.

Hi Wayne,
Thank you for taking the time to visit our website and for your comments. We’re happy to hear you enjoy Islands! To help settle your bet, we did have flautas on our menu called Moku Sticks. Since our philosophy is to keep the menu as simple as possible, we removed some slower selling items and replaced them with new ones.
Thanks again for your comments and continued support of Islands.

So yes, Macy has one over me but can you believe that Macy actually enjoyed a "slower selling item" on Islands' menu and was looking to order it again?

People who say, "I'm not good enough for you." Seriously, what the fuck?! I think it's better if you just go ahead and tell the other person that they are not good enough for you. I mean that's what most of you who say that ugly manipulative phrase are really trying to say anyway right? Just say, "You are just not good enough for me." It's a simple matter of switching a couple of pronouns. Even if you're trying to be nice about it, don't tell someone, "I'm not good enough for you" because by saying that, you're telling someone you know what's best for them when apparently they don't even know what's best for them. Now how do you know that? How can anyone say "I'm not good enough for you"? It's condescending is what that phrase is. Usually when "I'm not good enough for you" is said, the "you" thinks all the world about the suddenly "not good enough" person. You know what that does to a person? It fucks 'em up, is what that does. Another thing, by saying, "I'm not good enough for you," you're putting yourself down and that takes away some of the pleasure of "me" putting "you" down. Hell, it sometimes leads to the person saying how good the person who just rejected them is and that's just perverse and so wrong in a Michael Jackson likes little boys in his bed sorta way. So when you're rejeting someone, don't you dare say, "I'm not good enough for you."
I guess what I'm trying to say is that if you're going to reject someone just be honest about it and don't try to be nice because lying or even trying to be nice about it just makes it all the more worse.

Me: Ok, but isn't something happening on that date?
Brian: It does sound like a familiar date doesn't it?
Me: Yeah, but what is it?
Brian: I don't know.
Last night.
Bunny: Keep the date Sept. 23 free.
Annie: Oooo it's Bunny's big Three - Oh.
Me: Not 31? I thought you were already 30.
Bunny: Thanks Wayne. Hey Brian, keep Sept. 23 free.
Brian: Okay.
Me: Hey Brian, doesn't Sept.23 sound familiar?
Bunny: Yeah, it's my birthday.
Me: No, something else.
Brian: Yeah, it does sound familiar.
Me: Is there something school related that day?
Brian: I don't think so.
Today.
Brian: I have a challenge for us. Want in?
Me: Do I have to go into this challenge blindly?
Brian: No, I'll tell you what it is first. Remember that game I wanted to go to on Sept. 23? Blah, blah, blah, blah.... So you want in?
Me: Sure, but aren't you forgetting something about Sept. 23?
Brian: What?
Me: Don't worry. It's not like you're a bad friend. We both remembered when you originally mentioned that game that the date sounded familiar.
Brian: Bunny's bday.

Friday Spies© : Navel-Gazing Edition
Thank the BTQ guys for this.
1. Why did you start blogging?
I didn't want to forget the experience of what I had gone through during my first semester of law school and I didn't want any of my friends to forget either. I remember thinking over what I had just gone through after that first semester. In doing so, I found I was smiling and laughing to myself of things said and done. I realized that I was reminiscing really only about the good experiences and not the bad ones. And I just didn't want to forget any of them.
2. Are the reasons you blog now the same as when you started? If not, what's changed?
Well it obviously includes more than just that first semester now but it's still pretty much the same. I guess I started posting more about things that aren't even remotely related to law school, much less my personal experiences in law school, or the friends I've made in law school. But I still think the original focus of this blog largely remains and a majority of these posts and the links contained therein are still a bunch of inside jokes or references between myself and my friends at school.
3. What would make blogging better for you?
Inspiration strikes at the oddest moments and usually when I'm nowhere near a computer connected to the internet and I usually forget those inspiring moments other than that it was an inspiring moment. So if there were a way to blog instantaneously by simply thinking of a post, that would be nice and a really nerdy and inconsequential superpower.
4. Do you have comments on your blog? Why or why not? Do you comment on other blogs? What motivates you to post a comment?
I live for comments. Most of the time the comments make the post better. So comment away people. That and I'm trying to make it as easy as possible for Ms. Alba to leave me her digits.
I do comment on other blogs whenever a particular post motivates me to do so.
5. What is your philosophy of the blogroll?
I link to those blogs I read and to those who link to me. Though I'm currently considering paring it down to only those I read on a frequent basis. Now that would be telling, wouldn't it?

Some law professors should just stick to teaching inside the classroom and avoid any interaction with students outside of the classroom. What an ass.

The Japanese Is Right, The Chinese Is Wrong
The phrase "vindictive asshole" comes up with 363 hits on Google. So the phrase does exist. Of course, there are 2,710 hits for the phrase "vindictive bitch." That would be close to 7.5 times more vindictive bitches than vindictive assholes which correlates nicely with the theorem that women are evil. Especially in groups.

What Does Hearing Have To Do With Golf?
Hall said he's not handicapped by his disability, although one time in college he was penalized a stroke for picking up his ball because he didn't understand there had been a rule change for the tournament.
And there's actually some advantages on the golf course for being deaf, he said.
"I can't hear the distractions. I can't hear the airplanes," Hall said. "But I still struggle with my mental game. Just the same as any other golfer."
So does this mean we can cheer for him on his backswing?

What's with people who bring food, drink, or laptop with them into a public restroom? Not that it's much better with a private bathroom but I'm less than likely to see that.

You are Emergent/Postmodern in your theology. You feel alienated from older forms of church, you don't think they connect to modern culture very well. No one knows the whole truth about God, and we have much to learn from each other, and so learning takes place in dialogue. Evangelism should take place in relationships rather than through crusades and altar-calls. People are interested in spirituality and want to ask questions, so the church should help them to do this.

A Buck Ten My Ass
This filipino recently weighed in at at 183 lbs. That would be about 5 or 6 lbs. lighter than when I started my membership at LA Fitness about 5 months ago. They told me that my target weight should be 163 lbs. I'm way behind schedule.
Take It For What's It Worth

Third-Tier Conversation
Macy: Want to hear the funny story now?
Brian: Yes, but it better be worth it.
Macy: Well my boyfriend doesn't like the idea of us hanging out together.
Brian: Why not?
Macy: Because he feels threatened by you.
Me: Hahahaha.
Brian: That is funny but why does he feel threatened by me?
Macy: I don't know. It's just a vibe he gets from you.
Brian: I give out a threatening vibe?
Macy: To him, yes. He notices that we spend a lot of time hanging out together, talking on the phone, and chatting online.
Brian: Oh.
Macy: But I told him I do the same with Wayne and asked him why he doesn't get the same vibe from Wayne.
Me: I don't threaten him?
Brian: Yeah, why isn't he threatened by Wayne?
Me: Yeah, why isn't he threatened by me?
Macy: It's because he sees you as an older brother to me and he thinks you're really funny so he's not threatened by you at all.
Me: Well this isn't really a funny story anymore. Not for me anyway.
Brian: Yeah, for you, it started out as a funny story and ended up as a sad one.
Brian: Yes, but it better be worth it.

I hate it when an opening against oncoming traffic while trying to make a left at a busy intersection is thwarted by dumbass pedestrians rushing into the crosswalk as the signal blinks a red hand. One of these days I'll be forced to decide whether to run over a dumbass pedestrian or get t-boned.

Question: What Is Wayne Not A Fan Of?
I know, not a great question since there are many things I'm not a fan of but I do have something specific in mind.

Gift Idea For Brian
Not for personal use, but for him to give to his niece, of course. And for the rest of us, happy pooing everyone!
Butterfaced Or Not...
I wasn't the only one who thought there was something wrong looking with Krystal.
And really, this whole thing about me having a thing for blondes needs to stop. You're all confusing me with the Japanese guy.
As far as we know, Krystal wasn't a man...

Charlie And Neverland Ranch The Chocolate Factory
Does anyone else think Johnny Depp looks like a child molester, luring the kiddies with candy and Oompa Loompas, in his new movie?
I Really Hope Not
If anything, anyone reading this blog should be dissuaded from going to law school. Best comment left:
On blogs you can ignore the gunners and idiots while in law school they waste an inordinate amount of time that could be better spent drinking.

Thank You For Doing So Reluctantly, Duckess
Late last month, the State Bar Board of Governors voted to increase application fees by about 14 percent, with the cost for general applicants going from $464 to $529 and the cost for attorneys jumping from $674 to $769.
In addition to the exam fees, the State Bar also plans to increase registration fees for general applicants from $80 to $92, for attorneys from $145 to $166 and late fees from $45 to $52.
The cost of a moral character determination goes from $378 to $431 and admissions certificates from $60 to $69.
The Committee of Bar Examiners said it suggested the increases reluctantly, with its members saying they are "acutely aware that many, perhaps most, applicants are entering the admissions process with substantial student loan debt levels."

A review of your grades indicates that you are not as stupid as once thought you have achieved a grade point average of 2.000 or greater if not for our grading policy, it wouldn't be that hard to "achieve" in the Spring 2005 semester. You shouldthank your lucky ass be very proud of those who fell to the misfortune of illogical grading of the hard work and effort that has trapped brought you to this point. I encourage you to continue good practices such as regular flossing class attendance, thorough preparation, and avoidance of excessive alcohol consumption outside work so that you remain on your current path to mediocrity favorable path.

For The Ladies Taking The Bar Exam
If you're going to cheat by having someone take your place, make sure he's rightly proportioned.*
Also, I'd like to add that it should not surprise anyone that a guy would get it wrong by overestimating. And I'm sure the security staff was not only surprised by their discovery but also disappointed after having paid particular attention.
*Which I strongly suggest against anyone doing since it probably goes against that whole character and fitness requirement thingie.

Ladderin' Up The Beauties Of Beauty And The Geek
The WB ran a Beauty and the Geek marathon today and I was able to catch the last four of the first five episodes. If you want detailed episode guides with commentary, you can get them here, here, here, here, and here courtesy of Blonde Justice. All I want to do with this post is ladder up the ladies of the show and say that Lauren is so, so, soooooooo hot. Like get the milk and bread out, she's so hot. She rates like a high 7 or somewhere in the low 8s.
Lauren (so hot)
Caitilin (kinda hot)
Mindi (really, really cute, which gets her a 6.7)
Cheryl (potentially the hottest girl on the show)
Scarlet (looked good sometimes, not so good at others)
Erica (eh, I'd rate her a 5)
Krystal (can you say butter face?)
A few things have to be said. First, I didn't see the first episode where Cheryl makes her only appearance, but she looks pretty hot in the picture in the link provided and probably deserves to be ranked higher but won't be until I see confirmation in a rerun of that episode. Second, a lot of the girls look better on the tv than the pic they have up on the site. Third, my rating system is on a scale of 10 which is slightly at odds with the graphical representation of the ladder theory.
Basically, I'd actively like to eff' anyone rating 5 and up, 4's I'd eff' drunk and admit to, 3's I would eff' drunk and not admit to, 2's are the coyote ugly, and 1's are girls I just can't even look at.

The Things I Would Now Do For Gelato: Same Thing As Before
I've got the men's Wimbledon final going on in the background on the tv. I'm reminded that last year I was watching this event in England. On tv also, not live. It also brings back a flood of other memories. One of those memories is my first taste of gelato I got at Harrods. It was exactly one year ago. For some reason I didn't blog about it then. But today I have and today I'll be sure to have some gelato in celebration of that first taste and the attendant circumstances that made for that fateful day of my summer in Cambridge.
