After lunch I sat outside with Sean and Brian to go over Property. Nice day to be outside except that we were twice approached by guys who would qualify for appointed counsel. One of the guys was on a bike and a self-proclaimed "street comedian". One of his jokes:

As associate dean, former Prof. Civ Pro made an appearance at the Crim Pro exam. He was there to make sure no one was cheating. It was a little more than distracting having him stalk around the room with his presence. At one point I thought about getting up to go to the restroom to see if he would follow me. But in the end I didn't want to risk putting myself in a position where another man would be following me into a restroom.

So Brian asks me not to say a word to someone that he relayed to me about such-and-such about so-and-so hooking up last semester because he thinks someone would get mad at him. That's about as good as it gets and don't expect it to stay that good either because someone definitely talks way too much - I'm referring to myself not to one of the so's.

Const. Crim. Pro. Exam
Aside from the playful banter with the proctor, the morning was a bit of a nightmare. Six call of the questions when all of his previous exams that we practiced on had three. It was a racehorse type of exam so it's kind of reassuring to know that probably no one got to all of the issues and it's definitely assuring to know that no one fully analyzed each and every one of those issues. The multiple choice part of the exam was rough as well. Out of the thirty questions asked I was absolutely certain on only three of them. The others had two good answers and it was difficult for me to pick the best answer from the two. The exam ranks as one of the tougher exams I've yet to take. Going into the exam I thought it was going to be one of the easier ones. That makes the upcoming exams even scarier. Yes, exams can be scary. My sole comfort is in the fact that just about everyone else thought it was a tough exam.

It Would Only Be The Fair Thing To Do
ABC-TV journalist Ted Koppel, who caused a firestorm of controversy with his plan to read the names of U.S. troops killed in Iraq, today announced that in the interest of balance and fairness next week he will read another list on his show, Nightline.
"I would never want anyone to accuse me of bias. After all, I'm a journalist, devoted to accurately portraying world events," said Mr. Koppel. "So, next week I will read the list of Iraqis who were raped, tortured and killed by Saddam Hussein's regime after President George H.W. Bush declared victory in the Gulf War on February 28, 1991."

Study For Finals Or Play Pacman[hattan]?
I don't know which I'd rather be doing right now.
A player dressed as Pac-man will run around the Washington square park area of Manhattan while attempting to collect all of the virtual "dots" that run the length of the streets. Four players dressed as the ghosts Inky, Blinky, Pinky and Clyde will attempt to catch Pac-man before all of the dots are collected. Using Global Positioning, WIFI internet connections, cell phones and custom software designed by the Pac-Manhattan team, Pac-man and the ghosts will be tracked from a central location and their progress will be broadcast over the internet for viewers from around the world. Law School Memory #26: Turtle Dance
When at Tommy's, Annie did a dance after being reminded that Sean's middle name was Paul. I think it was Trini that relayed this information back to Sean who has since demanded to no avail that she perfrom her dance of mockery for him. Well the other night after dinner at CPK on 7th and Fig., Sean said he would mock Annie with a Turtle Dance if she didn't do the dance for him. It led me to suggest that they battle right there on the 7th level of the parking structure to 7th and Fig. In a futile effort to get Annie to go first, Sean went first. What followed had to be one of the greatest acts of physical comedy that words can do no justice so I won't even attempt to describe it. The fact that it was completely unscripted and spontaneous also made it an act of pure genius. It's one of those things I won't ever have to come back here to be reminded.
And yes, Annie still has to show off her dance to Sean.

Although some skeptics dismiss the devices as novelties more suited to a TV game show than a lecture hall, educators who use them say their classrooms come alive as never before. Shy students have no choice but to participate, the instructors say, and the know-it-alls lose their monopoly on the classroom dialogue.

The toughest course for me this semester are Property and Civil Procedure. I'm thinking most people in my section are going to be really ready for Crim Pro which will make it a tougher curve to do well on. I figure I need about two whole days for each course to really go into the exam confident. I'm sure I can figure this out. So Annoyed
First, I had to call up the place that had my laptop because they didn't call me like they said they would after checking it out. They told me I had to replace my hard drive and that it would cost me about $170 -$210. With no money left, I declined and asked if I could come by and pick it up. They told me that the hard drive was back in and was ready for pick up. I arrive and had to wait about 20 minutes while they actually put the damn hard drive back in. So out a service check fee of $55, still without a reliable laptop, and now facing the possibility of having to write out my exams. I'm so annoyed.
Contracts Review Session
I actually understood a lot of what Prof. Contracts went over. Understood but did not remember - there's a difference - so I'm thinking that the final won't be so bad so long as I give myself enough time to review everything, which is a lot easier to do than finding time to teach myself everything. Anyway, he ended the semester as I thought most professors would, some words of encouragement, congratulations, and a song parody. Well maybe I don't expect a song from each professor. Wish I could remember the lyrics or at least the chorus but my mind is too preoccupied with finals and my laptop to remember and recall such things.
After the review session we went to Larchmont Village and ate at Cafe du Village. The menu was written up in hard to read font, the food was ok, and the service was terrible. Lunchtime conversation was great as per usual with these people, again I wish I could recall a few things to quote but can't. Damn finals.

This Has To Be A Joke

About US: 'Operation Take One For The Country' (abbreviated OTOFTC) is a movement of like-minded women (women predominantly as of right now) who have covertly organized into groups to frequent eating and drinking establishments near armed service bases where troops are preparing to ship out overseas, and take one for the country, so to speak. Resorting to match.com doesn't seem like a good idea for a student since those gals are normally interested in guys who can pay for a "good time" and thus impress their friends.First, thanks for the dating advice. Second, there aren't that many dateable women at SW. I think most of the hot women in law school are attending the fourth-tier law schools. Maybe Bronson will tell. Third, it is a matter of opinion and mine is that I don't believe SW is in a ghetto location. But if you're from say a rich mostly white suburb of a city like, oh say, Denver, then you're probably going to think it's ghetto. I encourage an on-campus visit so you can form an opinion of your own.
Anyway, aren't there enough women at SW for dating? Maybe scoring at the non-ABA accredited schools would be a better strategy
By the way, someone had mentioned on a review site that SW was located in a ghetto part of LA and is not safe. Is that your opinion too?

We all have one: the Prize. Something that we've promised we'll buy ourselves as a reward when we get through all the exams, write all the papers, and slide into that shiny new job. After all, you don't slave for three years and work yourself to death in order to get money. You sell your soul for the things that money buys.I didn't promise myself a Prize, which may explain my performance on last semester's set of exams. Getting a job - any job - after graduation would be reward enough for a Southwestern grad.
Since we're all stressing like mad over exams, the Prize is probably more on our minds than normal. So in the name of fostering avarice everywhere: tell us what it is. Just leave a comment with your particular prize, or if your a blawger, just make sure to track back to this entry. Eventually we'll have a master-list of law school avarice, and then we can... we can... erm... I'm sure we'll find a use for it somehow.

Sectionmates
I'm in general agreement with this:
The bad mood days have to go though.
My classmates are one of the best parts of law school. I look back on that advice ["You will like the subject matter, and you'll like the professors, but your classmates, you won't like them."] and laugh. My classmates are smart, motivated, compassionate, idealistic, funny, hard-working, generous, and respectful. Sure, some of them have their quirks. Sure, not everybody is happy all of the time with everything. But heck, who doesn't have quirks? Who is happy all of the time?I've been as fortunate as her if not more so. My sectionmates, and I'm not just talking about those who are my friends, have easily been one of the best parts of my law school experience. They never fail to let a class go by without at least teaching me something new or giving me a reason to smile amid all the law school drudgery. So as odd and annoying as some of them can be, I can't imagine a better law school experience without any of them.
But most days, allowing yourself a bad mood day here or there, you'll like your classmates. Honest. And, if you're lucky like me, they'll be one of the best parts of your law school experience.
The bad mood days have to go though.

He slept on library chairs and carried vital belongings -- a laptop computer, books, clothes -- in his backpack.

The thing I'm most concerned about is whether that would leave me enough time to specialize in any one of those areas of law having only taken three courses in each of those areas. I'm in need of guidance. Help!

Registration Numbers
My registration number for the Fall is 174. My registration number for the Spring is 54. It looks like I'm getting stuck with Prof. Civ. Pro. II for Con. Law. By the way, those with a real choice should choose section T1. I heard the professor teaching Con. Law for that section is the one take. On the bright side, if I do get stuck in section S1, I'll have Prof. Contracts for Bus. Ass. the following Spring.
Stupid 2Ls
So Prof. Civ. Pro. II, who is also Prof. Con. Law, is sitting outside of his class as they fill out evaluations. Two guys from that class just walked out without seeing the professor but saw a fellow classmate about to go in. In passing each other by, they tell the classmate that they're skipping class to go study Con. Law at the library. Of course, the professor overhears this and announces his presence by telling them to stay for class.

Now I'm all for a woman's right to choose - which may make me more of an anomalous Republican as I also don't listen to country music - but there are some people on that side of the debate I'd rather not be associated with.

Playing For The Chargers Just Can't Be That Bad
After a tense hour in which Eli Manning was a prospective law student, the NFL's first family of quarterbacks got what it wanted.
In one of the more bizarre first hours in recent draft history, Manning was taken with the first pick by the San Diego Chargers, for whom he announced he wouldn't play.
An hour later, as Manning walked away from the podium at a press conference in which he insisted he would go to law school, someone rushed into the room to say the Giants just obtained him for another quarterback, Philip Rivers, whom they had taken with the fourth overall pick.

Here's what I've been using to help think through and organize the practice exam for Crim. Pro., it's taken from this book.

Today's Plan
Working on a past Crim. Pro. exam or two using notes. The one I'm currently working on deals with search and seizure and at first glance it seems to involve issues of overnight guests, consent (third-party authority), plain view doctrine, automobile exception, SILA, and exigent circumstances. It's a lot for what's actually a comparatively short essay question.

Someone Is The Clever One
Today
At the library beginning to paint my masterpieces because law exams are my art. I'm starting with a piece I like to call Property.
Yesterday
Last class for Torts and Civ. Pro. II. Prof. Torts was applauded nicely, Prof. Civ. Pro. II was not but that is what happens when one passes out brownies on the last day and the other schedules a two-hour review session at 4-6 on a Friday on top of the regularly scheduled class. Lunch saw Brian fail at two commitments, which is why he doesn't make them. Robert finally boba'd with Annie. I didn't share brownies after Torts. Review session was a waste. Drinks and food were had at a USC hangout. A few of us went to see Man on Fire at The Grove. Stood in line forever. Brian got to touch the screen for food. There was as many commercials as previews. Movie that started at 10:30 actually started just past 11:00. Made it back home by 2:20.

Shall I Nominate Prof. Civ. Pro. II?
Nominations are now being accepted for the Law Prof 100, LawTV's ranking of America's most influential law professors [I wonder how many from my school will be honored just to be nominated].
This influence can be, for instance, through academic writings, popular writings, litigation, media appearances, business activities, teaching, lecturing, charitable work, or scholarly impact [well if this is what they call influence...].
You may nominate up to 10 law professors -- including no more than five from your own law school [can I come up with even one?] and no more than five from other law schools.
Only law students [that would be me] (full-time or part-time), law professors (including adjunct professors), and law school administrators are eligible to nominate. Your law school must be located in the United States and may be ABA-accredited or non-ABA-accredited [a standard Southwestern might actually meet].
After nominations are completed, an announcement will be made on LawSchool.com of the top 250 nominated professors.
Then, voting for the Law Prof 100 will begin [I wonder how many from my school will make the final list].
So I Guess Skipping The Dissent Isn't Such A Good Thing?
Ernie advises law students to read the dissenting opinion to a case before reading the majority opinion.
I've heard this advice before -- the primary justification is that it can key you in to the points of contention in a case, and you don't have to deal with the fluff.
[I]t's certainly true that sometimes reading the dissent first can save you time.
Make ShitBegone Your Brand
ShitBegone Value rolls, although they say "pillow soft," don't feel soft in your hand. The paper inside is soft, but the roll is not. The reason is this: Marvin Ferris, the supplier for this paper, is an old-timer. He's about 85 years old, and he has a problem with what other companies do to make their rolls feel "soft". It's called embossing— basically, crushing the paper between textured steel rollers, to make little bumps on it. That way, when the paper is rolled up, the layers don't lie flat. And so the rolls feel soft, because there's air in them.It's not quite Vapoorize but it'll do.
In some brands, the rolls are 60 or 70% air. All that air uses extra space and fuel during handling. But embossing doesn't make the actual paper soft— in fact, it can make it scratchier. Hence Marvin's position: he's in business to sell toilet paper, not air. He refuses to emboss, and so his rolls are rock-hard. It's a tough sell these days— when young people are used to squeezing the Charmin. But the paper works well, and it's honest. For ShitBegone Value, that seems to make sense.
Today
It started with a quick look over the Property practice exam with Annie, Brian, and Bunny. Then there was a three hour Property session. Found out that Annie was on top of the Unclean Hands Doctrine and that we came up with a subtle argument, good for us. Lunch at Koo Koo Roo with Arpineh, Brian, Bunny, Rita, Stummy and Trini. Hot Mooter made an appearance, I restrained myself, you can thank me later Stummy. Read the bricks. Sean went on a fantastic rant against kissing ass for a career. An hour of Crim. Pro. Wet USC car. Workout at the gym. That was it and that was all.
I Probably Should've Waited Longer Before Entering Law School
It took everyone at the Syracuse University law school a little while to get used to the idea of an 81-year-old first-year student.
This Is Something To Look Forward To
Billable hours.
When I summered at BIGLAW and was getting used to it for the first time it made me so anxious.... You fumble around on a project feeling like a complete idiot, with time ticking away, and at the end of two and a half hours you've been down half a dozen blind alleys and have half a paragraph of tepid conclusions and realize you don't really understand what you're supposed to be doing anyway. Do you bill that 2.5 hours? On the one hand, great, 2.5 hours, that's a nice big chunk of billable time -- great! I hope this will take me a lot longer to finish up. On the other hand, you realize, someone's going to look at this piece of paper and think, "We've hired us a complete idiot! It took her 2.5 hours to do this simple project, and she's still not finished." Maybe you should only write down 1 hour. But where are you going to get the other 1.5 hours? Stay later? What if while you're trying to catch up you're only slightly less clueless?

Unappreciative Sumofabitches
I just realized that we didn't give our Property professor applause after she finished up the last class of the year. It was the end of a three hour double session that had left everyone drained and she isn't the most liked professor. But isn't that just wrong? And should applause be reserved for genuine gratitude or given everytime out of courtesy?

Today At The Gym
Miss U OF A - or Miss University Of Fine Ass as I like to think - was there. It made for much better scenery than yesterday - sorry Brian but you're cute too so don't worry about it. Bunny and Annie joined the Wednesday regulars, which made for more hanging out than working out which was more than ok by me. Afterwards, we threw it all away on a single fry, as Trini put it, at Tommy's. The ride back to school saw Annie showing off her vast knowledge about Cholo's - having dated one - and her limited knowledge about this song.

What's With Me And Elevators?
So it's after Property and Sean, Jeff, Sally, Yanna, Brian, Bunny, and I piled into the elevator -after some talk about the origin of stroganoff, looks like I was right - and rode it up to the sixth floor to get down to the first floor. As we stopped at the sixth I saw my Fan Club and tried to hide behind this really huge guy to no avail. Also to make into the elevator were Liz and Aylin. So Caroline saw me and the following conversation - to the best of my recollection - ensued:
Caroline (to me and everyone else in the elevator): Hey Wayne, I slapped Liz's ass for you.Amid all of that, Yanna mentioned she felt left out and Sally kept saying words of disbelief. As Bunny remarked, I've made a name for myself.
Liz: It was different from what Wayne did though.
Brian: Was it different in a good way or a bad way?
Liz: Well there was more of a pause and a pinch when she did it.
Brian: Make a note of that for next time Wayne.
Liz: But no one could slap it harder than Wayne.
