What Just Happened Here?

My quiet study environment has just been invaded by two rugrats. One is really trying to be nice to the other but the other one bit the other on the hand and won't share his Triple Action Web Blaster. This is not conducive to a learning environment to say the least.

UPDATE: They are now running around, playing Spidermen. Lots of yelling involved. This would be amusing if I didn't have to outline. Well it's still amusing but it's definitely giving me greater excuse to procrastinate.

UPDATE: They have now taken to going under the table and slapping me on my knees.

UPDATE: There's now a screaming match.

UPDATE: Right now, I'd rather risk having cancer than risk having kids.

UPDATE: Kids who speak a foreign language are funny, especially when they point at you and yell something in that foreign language.

Reason Not To Want To Have A Take Home Exam

From Yet Another Michigan Law Student

Stole this from here:
Population of the reading room, as of 4:08 p.m. on Friday, March 26, 2004:

1. Blonde girl in far corner, twirling her hair and playing with her glasses. Types a few words and then stares off into space for hours at a time.

2. Girl with huge laptop, drinking a Diet Coke and smiling at the screen. Probably internally chuckling over a politically-themed email forward. No books in sight.

3. Guy in polo shirt drinking out of a bike water bottle. Reading for what looks like a seminar and playing brick attack on his cell phone. Thinking about calling it a day.

4. Really diligent girl to my left who is actually doing work. Reading intently, outlining intently, not noticing the blueness of the sky or the futility of her existence. Simultaneously admirable and pathetic.

5. Dude next to me. Lots of books and highlighters, none of which have moved in three hours. Probably reading ESPN. Intimidates me anyway because the books are for one of my classes, and he looks like he's really up on things. Makes me hate myself for falling behind.

6. Girl behind me. Also really doing work and constructing beautiful, handwritten case briefs on pristine yellow legal pads. I hate her with an indescribable passion, but also want to be her friend.

7. Me. Sitting under a pile of Westlaw printouts, trying to avoid looking out the window, filling with more and more resentment as the day goes on, feeling my back and neck start to tense up to the point of paralysis, wishing I could be at a crawfish boil, even though I don't eat crawfish, and their little black googly eyes scare me a lot, and so does their poop, but I would eat them anyway if I could just leave this godforsaken place.

Get The Chemo Ready, I'm High Risk

From here:
Frequent sexual activity may reduce a man's risk of prostate cancer, according to a study in the April 7 Journal of the American Medical Association.
Frequent? Just a little and I'd happilly die young from cancer.
More research may help determine how sex might be protecting some men from prostate cancer, the investigators said. The results shouldn't be used to encourage intensified sexual activity, defined as ejaculation from intercourse, masturbation or during sleep, they said.
Like hell it shouldn't! My new pickup line: Hey baby, forget the ACS, there's a better way for you to help the fight against cancer ;-).
The cancer risk in men who reported more than 20 monthly ejaculations was 33 percent less than that of other men, the Harvard University study showed.
Well if all I have to do is ejaculate more than 20 times in thirty days and nights, then I'm in the clear. Ain't that right Lefty?
There are several ways in which frequent ejaculations may protect against prostate cancer, the researchers said. The activity may flush out a buildup of toxins in the prostate, lessen development of tiny crystals linked to some cancers, and improve the immune system's response to cancer, Leitzmann said.

Ejaculation also may release psychological tension, quieting central nervous system activity that may contribute to prostate- cell division and cancer growth, the researchers said.

Quick Thought

Glannon's Examples & Explanations for Torts needs a chapter on products liability.

Spring Break Day 3

Working on Torts today. I'm pretty much up-to-date on all the reading for this class so I'm most likely going to do my own outline for this class even though I didn't have one - mine or anyone else's - last semester and still ended up with my best grade.

Staying Home Today

Grandma left for the Philippines last night and everyone else is going to work. Nice opportunity to stay home and hopefully be productive. Yesterday wasn't so productive. Didn't even get through a quarter of what I wanted to read. Now I have to make time that I don't have to do it.

Who Is/Was At The Library Today

The library has been fairly quiet so far during Spring Break. Today I've seen Aylin with Charles The III, Sean R. with Vinny, Danny, John, Sharokh, Scarf Girl, and Brandy with Jen M - and just now, Morrisson.

Looking For Contract Hypos?

There's a small stack of papers for Section C's Contracts class at the table by the print shop that include examples and hypos but no answers. It should still be helpful though.

This Just In

Mr. Brophy now works at the school's gym. Getting paid to study as he put it.

Day 2 Of Spring Break

Working on Property. Yesterday I didn't actually outline for Crim. Pro. All I did was read the relevant chapters in Examples & Explanations - a good refresher - and printed out the outline that Bunny had sent me from Annie. I'm thinking about doing the same for Property by reading Understanding Property Law and then printing out APALSA's outline which is keyed to Prof. Property's class. The thing is, is that there's a lot more reading in Understanding Property - about 400 pages - that I have to do than I did in Examples & Explanations for Crim. Pro. Once again, wish me the best.

If Bunny Hasn't Already Picked Out Bridesmaid Dresses...

Taken from here comes this story:
No problem for Lynlea Jayo and Josh Traughber, a high school couple who used duct tape, thrift-store jackets and bed sheets to make their own formal wear for just $30.

Jayo and Traughber's creativity put them in the running for $2,500 scholarships. The Duck brand duct-tape company also gave $2,500 to the school as part of a national contest.

Her dress was made from an old bed sheet. She used three rolls of black and red tape on the hourglass-shaped gown with spaghetti straps.

Because of an extra layer of duct tape, Traughber's jacket weighed 14 pounds. He also made duct-tape slacks, a duct-tape T-shirt and a black-and-white checkered tie using six rolls of tape.

Living With Parents

Reasons to live at home your first year of law school, reasons not to live at home your first year.

For me, the biggest upside is that it enables me to get away from school, even if it was just for a few hours, which was usually spent sleeping, showering, and eating during the first semester. The biggest downside is that I occassionally bring home the law school stress and allow it to adversely affect my familial relationships. On balance, it's been more beneficial than not.

Good Thing I'm Procrastinating Rather Than Watching The Dodgers

Just checked out Sportsline's scoreboard and saw that the Dodgers gave up 6 runs in the top of the 5th and are now trailing the game 7-1 after 5 innings. I hope it hasn't put on a damper on things for Brian and Sean.

UPDATE: 8-2 is the final score. And by the looks of it, it looks like the Dodgers left a lot of men on base.

Maybe I Really Am Dolce & Gabbana

So Stummy took the fashion designer quiz that I took and it describes her as "snobby", "always elegantly outfitted in the latest trend", and "tend[s] to go after the rich CEO". Now go read about Stummy's Sunday and how law school students' competitive nature can emerge in a situation outside of just school and grades.

Today

I'm working on a Crim. Pro. outline. Wish me the best.

First Weekday Of Spring Break

And I'm in the library as it opens. The Dodgers open their season at 1:00 pm and college basketball's title game begins at 6:00 pm. I'm going to miss the Dodger game and most likely the basketball game as well. If the wireless is working outside, I might be able to enjoy some of the nice weather today. I love law school.

Quoting Lawlessgal:
I have less work to do this semester, but find it much harder to get it done. I don't know if this points to the fact that I work best under pressure, or if I'm simply tired of working. Last semester I was very focused on doing my absolute best. This semester it's all I can do to show up for class with the reading done. This does not bode well for finals and I need to change my attitude. Suggestions welcome.
Welcome to the club.

But why is it like this for so many 1Ls? And why can't I shake myself out of it? Let's hope my attitude changes during Spring Break.

This Is What Law Students Discuss When Not Discussing The Law

Liable asks, "Do you ever get the sense that God invented law school in order to rid the world of yellow highlighters?"

It reminds me of a conversation that Bunny and Turtle had one morning before Civ. Pro. about how Turtle would highlight the same text twice with different color highlighters just to get the preferred highlighting color - probably orange, her personal favorite - and how difficult it was for Bunny to find the rare purple highlighter.

It also reminds me of the time when Annie said that the highlighter Bunny gave her - an orange one - looked like a vagina when viewed into.

Dear Continuing Student:

Recently, Southwestern University's Board of Trustees reviewed the School's most pressing issues and developed goals and a budget that they believe will be adequate to maintain and enhance Southwestern's programs To maintain the highest quality educational experience was of utmost concern.

After scrutinizing Southwestern's needs, the trustees set the fiscal year 2004-2005 tuition at $950 per credit unit. This rate will be effective with the 2004 summer session.

Which of the following is a reasonably foreseeable misuse of the product?

a. 11-year-old boy riding a vacuum cleaner as if it were a toy car and his penis into the casing of a vacuum cleaner and being injured by the fan blades.

b. Child injured while playing with a disposable cigarette lighter.

c. Two-year-old riding in small wooden box being pulled a riding mower. Mower hits a tree, child is thrown off, operator jumps off to pick up the child, and the mower runs over the child's leg.

Foreseeable misuse of the vacuum cleaner, cigarette lighter, or riding mower?

Yesterday

After classes, PeShawn, Rita, Bunny, Annie, Brian, and I went to The Cheesecake Factory in Beverly Hills. I had the Amaretto Milkshake and Buffalo Wings. The talk included Rita being in a bad mood, Brian liking bananas and cream more than a man should, Bunny saying inappropriate things in public, myself parroting those inappropriate things in a MUCH LOUDER voice, the service being bad, appropriate tipping, girls in our section, girls walking down Beverly Dr., old people's hearing, the meaning of irony, and Smoking Kills cigarette brand. In the end, we were well fed and shared a few good laughs.

SBA Elections

Trini lost out on the Presidency, which makes my position as SBA Liaison all the more appealing. (Note: to the immediate left of this note is what is commonly refered to as sarcasm as another example of sarcasm: Thanks once again Stummy!) The only TVAD candidate to defeat a SW Bunch candidate was Daphne for secretary.

Yesterday

Well yesterday provided many quotes (see below). Let's see if I can put some in them in their proper perspective.

The day began with Property. Macy, for the umpteenth time, walked into class late. Our Property professor has this thing about punctuality with regards to the morning class. In what I presume to be a pre-emptive move on her part, Macy volunteered an answer but that wasn't enough to keep her from briefing the condominium cat case for the class. Prof. Property then came up with a hypo wherein she relates to her cats as if they were like her children. Bill misunderstood and took it to mean that she thought of her cats as actual people.

After Property was our three hour and forty-five minute break. Rita worked out with Trini, Annie stayed behind alone because she was slow, and the rest of us made our way back home. We all returned by 2:00 for Crim. Pro.

In Crim. Pro. we discussed the rule formerly known as Standing (Ankh). When asked about where in the Constitution a certain right could be found, Daphne responded with her quote. Also in this class, Macy raised her hand and was called on but either she forgot her question or thought it wasn't a very good one becaue she responded with, "Nevermind, I was just kidding." Because of that, Professor Crim. Pro. came back to her again and during the line of questioning she responded, "I'm just kidding", which prompted Prof. Crim. Pro.'s quote. Also, Stummy's shirt which was "a FCUK baby tee that said 'Intercourse Activities FCUK Polytechnic' with the crucial letters HUGE right over [her] chest" got attention from Prof. Crim. Pro.

Later that day....

This Is Scary

"Hey Wayne, they say I'm just like you." - Bunny

Yes, I Am Evil

So the two-day election for SBA began today. I purposefully, didn't vote today so that Trini would have to kiss my ass for another day. Although, she has a very funny way of kissing ass and she did bring this up saying that I owed her and she was now cashing in. But that would also mean that I would have to vote against her slate for one of the positions because Liz is running on another slate - not that Trini seemed to mind.

This Is Why I Should Look Around First Before Yelling

Brian, Bunny, and I were outside of Westmoreland at The Promenade talking when Bunny posed a question.

Bunny: Did you see the sticker on Prof. Contracts' pants?
Me (yelling): YEAH! I'M LIKE, "PROF. CONTRACTS I CAN'T KEEP MY EYES OFF OF YOUR ASS BECAUSE IT HAS A STICKER ON IT!"

Unbeknownst to me, Prof. Contracts had just walked outside and was probably no more than 20 feet away from me, which had prompted Bunny's question. Brian and Bunny immediately turned their backs to me, pretending not to have anything to do with me, and were more than embarrassed for all three of us. I don't think he - at least I hope so - heard me. If he did, I'm hoping he forgets over spring break but just to be safe, I'm going to make sure I'm prepared for next class.

Taken from here which was taken from here.
[Fox] has given a eight-to-10-episode production commitment to the tentatively titled "The Partner," an hourlong skein in which a group of newly minted lawyers will battle each other to win a job as a partner in a major law firm...

Contestants will be divided into two teams -- one made up of Ivy League grads, the other consisting of players who attended less prestigious schools. Each week, teams will compete by serving as prosecutors or defenders in mock trials inspired by actual cases. A jury of real people -- selected by the lawyers/contestants -- will determine the winner of each trial...

Fox and Rocket Science are in talks with several well-known lawyers about coming on board to serve in the Trump-like role as judge.
If this show is still on when I graduate, I'm applying and hoping that there's a "from barely a law school" team by then.

It looks like a badminton net is being put up in The Promenade area to go along with the soccer goal. Next thing you know, Southwestern is going to have a marching band.

Just saw Sharokh and a running mate of his dressed in full moot court attire making their way, presumably, to the Commons for a dress rehersal. The expectation of a good performance during lunch is now on.

Brian made a joke yesterday about PowerPoint presentations being used at Bunny's Catholic marriage camp thingy, which I'm reminded of because of this.

A Kindlier Email

People with email addresses from St. Thomas, Santa Clara, University of Denver, Richmond, University of Arkansas, NYU, and UCLA received the following email as well.
Subject: Summer Entertainment and Media Law Program in Cambridge

I am pleased that you are planning to join us in Cambridge this Summer.
We expect to be sending you more detailed information about the program
in the near future and are excited about how things are developing. It
should be a great experience for everyone.

As you likely know, the program is oversubscribed--that is, we have many
more applicants than we can accomodate. I am sending this email to ask
anyone to advise me as soon as possible if your plans have changed--or
are likely to change--such that you will not be able to attend the
program. While we do not expect this to be the case, if there have been
any changes it would be helpful to know so that we can make the
opportunity available to other students who are on the waiting list.

Again, congratulations on being accepted into the program, and we look
foward to seeing you for what we anticipate will be a rewarding and fun
summer. If you have any questions, please do not hesitate to let me know.

Sincerely,

Last semester, I never played a game on my laptop during class. This semester, I'm playing lots of Ms. Pacman, Puzzle Bobble, Marvel v. Capcom, and Spider Solitaire during class.

One Of The Reasons Why Girls Suck

And not in the good way, meaning not in the way that requires them to get down on their knees. I better stop now before the fucking FCC fines me or shuts me down.

Last Semester, This Semester

Last semester, I rarely had a good night's sleep and was usually looking very tired. This semester, I'm getting plenty of good sleep and am feeling guilty about it.

Bastards

I'm sitting out in The Promenade and just saw Section C walk out from their morning class. None of them have the sniffles and none are walking with the aid of crutches. In sum, I see no excuses for their absence yesterday.

Last Semester, This Semester

Last semester, I listened to every word my professors said, even when it looked like I was sleeping - tired eyes. This semester, I'm not catching a word they say and I'm actually sleeping at times.

Just spent $64 plus on two hornbooks, one for Property and the other for Criminal Procedure.

After The Game

Brian, Scott, Jeff, Sally, Sean R., Bill, Niv, Darryll, and I went over to Island's on Pico. Niv made an order that would make Stummy proud. Brian said something about finding a lawyer for a spouse and Sally responded that she was going to marry a lawyer as well, which made Jeff nearly choke. The rest of the conversation was gossip about grades and possible couples in our section.

Last Semester, This Semester

Last semester, I took notes in class - not many, but I took. This semester, I don't take any notes.

Softball Game

As expected, Section B made a good showing but Section C produced only one player - in their defense, it is five weeks until finals and moot court just ended - so we ended up playing an intrasectional game again. Here were the lineups:

Jay's Team
Brian
Aylin
Scott (Brian's friend from Pepperdine)
Jeff
Darryll (my brother)
Sean R.
Brad

Joon's Team
Me
Niv
Sally
Doug
Dave
Bill
Brian (Joon's friend)
Paul

For the first three innings, Joon's team either tied up the score or went up by one. Then the fourth inning came and went. At the top of the fourth, Jay's team scored 20 runs to go up 19. Bottom of the fourth saw Joon's team go scoreless. Mercy rule, thankfully, kicked in. Final score: 30-11 after 4 innings and 1 hr. on a very hot day. Highlight of the game saw Brian knocking over his friend at home plate.

Educational Breakfast Today

Now that Legal Writing is over, has been for a few weeks now, section B has a three hour and forty-five minute break in between Property class and Criminal Procedure class on Thursdays.

Annie, Arpineh, Brian, Bunny, Sean and I went to The Original Pantry for breakfast. At this meal I learned that Annie has a thing about dishes stacked on top of other dishes that still have food on them; that Sean makes a great replication of Woody Hightower on a flagpole using only a straw, a Half & Half container, and hash browns; that the menu at The Pantry is simple and confusing at the same time - some meals come expressly with potatoes, other meals include it implicitly, and still others don't include it by inference? (seriously, rules/canons of construction are needed to read the menu there); that the waiter, while hard to understand, will get your order right; that the hotcakes there are heavy - there's an open question as to whether guys can have hotcakes; that the toast there is huge; that their butter is probably salted; that drinking from a coffee mug with your left handwhen you are right-handed is tough - but preferable if there's lipstick on your mug; and lots, lots more that I can't recall at the moment. A decent breakfast - the lunch menu looked more appealing though - with the refreshingly light and funny conversation that always accompanies.

Technology Still Hates Me

Still can't get the internet to work on my laptop. I'm annoyed.

ESSAY: How Not to Succeed in Law School.

From a section of the essay:
There are lots of fine law schools to choose from. For instance:

Harvard. Harvard is number one, as you can learn by asking anyone who went to Harvard. Or even if you don't ask. The only disadvantage of going to Harvard is that the graduation robes are the same color as Balls O' Fire Salmon Eggs.

Yale. Forget about Yale. It's so selective that no one ever goes there. If you find this statement doubtful, ask yourself this simple question: Do you personally know anyone who is going there now? Of course not. Oh, sure, there are lots of people who say that they went there in the past, now that it can't be verified. Don't you be fooled.

[*1683] Michigan. This is a good school, except the official school drink is Prestone. As each winter comes to an end, someone will have to remind you not to stare at that big yellow ball in the sky.

Chicago. Learn how many Chicago law professors it takes to screw in a light bulb. (Answer: None. The market will take care of it itself.)

Boalt Hall (Berserkeley). Boalt is built on a hill overlooking one of the most spectacular views on earth: the San Francisco Bay and the Golden Gate Bridge. Therefore, they naturally designed the building so that all its huge picture windows face directly into the fraternity houses across the street. You can't catch a glimpse of the Bay, but you do have a terrific view of fraternity blobs sitting around in their gym shorts, drinking beer, belching, and listening to the music of Twisted Sister at 300 decibels. Oh well.

Columbia. On the front of the law school building at Columbia, you will notice a huge sculpture of a man who has put a noose around the neck of a horse and is throttling it to death. You will not be able to understand the true significance of this sculpture until several days into your first year at Columbia.

Northwestern. Northwestern deliberately charges the highest tuition, on the theory -- called the "Ray-Ban Theory" -- that people will note the price tag and conclude that it must be the best school. Its goal is that eventually people will refer to Harvard as "the Northwestern of the Northeast."

Other Top Ten Law Schools. There are about twenty-five schools in this category. Consult this week's AP and UPI polls.

The "Middle Group." The Middle Group includes all other accredited law schools. These schools actually teach the law.

About Two Thousand Unaccredited California Law Schools. For example: Frank and Morty's School of Law and Cosmetology of the Lower Level of the Seven Hills Shopping Mall. Don't let the classy name fool you. There are basically two requirements for admission to this institution:

1. A pulse, and

2. $ 12,000.

The first requirement can be waived.

Be sure to avoid law schools with "Jr." in the name, such as "Leland Stanford, Jr. Law School." These are actually junior law schools.

Not That It Means Anything

As best as I can ascertain through Sitemeter, on Monday night Bunny became my 1,000th visitor with Brian being visitor number 999 and Stummy coming in at 1,002.

Encounter With Prof. Torts

Annie and I saw Prof. Torts after class and she related how sad it is that 1L's and professors after getting to know each other - not as well as I would like with regards to a certain someone - and attached to one another - not as well as I would like with regards to a certain someone - during that first year, don't get to see as much of each other after completion of that first year.

I satirically told her she was about to make me cry - but I didn't and without having to fan myself may I add - and I promised to visit her during office hours next year. Yup.

Good Thing I Didn't Do Third Round

I was doing some reading in room W311 with Annie when evening students began to filter in. One of them went on a rant about the Moot Court process. Basically what he was saying was that he was better than everyone else and was unfairly left off of the list of people going on to the fourth round because he wasn't "fashionable". So the cute went on and the smart - as he proclaimed himself to be - did not, so his theory went. Anyway, a very bitter and angry man motivated Annie and I to put our heads down and finish the reading for Property as quick as possible.

Maybe Bert And Ernie Can Help With Brian And Annie

Where countless politicians and diplomats have failed, Elmo, Cookie Monster and their "Sesame Street" buddies are on a mission to promote peace and tolerance in the Middle East.

A programing experiment using the Muppet characters was launched six months ago and was widely welcomed by parents, educators and the media. But the Muppets are not without their critics in Israel, the Palestinian Authority and Jordan.

Sesame Workshop partnered with local producers to create "Sesame Stories," an adventurous initiative to use new and existing "Sesame Street" characters to foster respect and understanding among children in the region.

Knell says. "Yes, some Israeli reports accused us of being lackeys of the Palestinians, while another article accused us of being lackeys of the Bush White House and charged that Elmo was carrying the will of the White House to the Middle East.

Technology Hates Me

Been having trouble connecting to the internet either wirelessly or through a cable. Basically, I can't connect to the internet at all, which makes it harder to post here when inspiration strikes. Which may account for the recent lack of quality posting here as Brian and Stummy pointed out today.

Once Again, Thanks Stummy

Because I was basically appointed as SBA liaison for APALSA, I now feel obligated to attend this.

Tomorrow

Civ. Pro. starts forty-five minutes early because Prof. Easter Egg is going to miss a couple of classes after spring break. That's two hours and fifteen minutes of Civ. Pro. It's a violation of my Eighth Amendment rights.

To Drop Or Not To Drop

I don't know whether you should stay in law school or not. Why did you go? I don't think it has much to do with being a lawyer. I mean, if you want to be a lawyer you have to credential yourself appropriately but as the folks at De Novo recently discussed the legal education and the legal profession are pretty distinct experiences. If you don't like law school you may still like being a lawyer. If you love law school you may still hate being a lawyer. If you don't want to be a lawyer and you hate law school, you probably want to take a break, and maybe drop out entirely.
Go read the whole thing.

UPDATE: More on dropping out:
A quick Google search finds me nothing comprehensive, but these interesting results:

Al Gore dropped out of law school.

Paul Simon dropped out of law school.

The writer/director of "Two Weeks Notice" and "Miss Congeniality" dropped out of law school.
Al Gore dropped out huh? That tips the scales towards staying in school. Go read this whole thing too.

Congratulations!

Goes out to Stummy for being named an alternate oralist and thus earning an interview for the Moot Court Honors program. And congratulations to the rest of those from Section B as well, disproportionately representing again, who earned an interview.

Read The Quote And #5

Repeat after me, don't date fellow sectionmates. And yes, 2 months is much shorter than 7 years so it's probably time for FG to give the watch.

I'll Drink To This

Drinking in moderation appears to reduce heart-related deaths in men with high blood pressure, new research suggests, challenging the belief among many doctors that alcohol should be off-limits to such patients.

"If I turned over a rock and saw one of these things, I would probably scream and run away. "

Ever heard of a pill bug? They are more regionally known as doodlebugs and roly-polys. They're those little bugs that curl up into a perfect little ball when you mess with them. I had great fun with them as a kid. I thought it was so cool that a bug could turn into a ball.

Well, they're not actually bugs -- they're crustaceans. This guy up here is a very close relative of the roly-poly, only it lives in the deep sea along the ocean floor. It's just like the ones you found under rocks as a kid, only it's really fucking big. It even rolls up into a ball!
