In the last few years, the number of offers for associate positions dropped nationwide, while acceptance rates increased. Permanent offers for the 4,233 students participating in summer associate programs in 2002 was about 81 percent, a decline from 84 percent in 2001. In comparison, the associate offer rate was about 90 percent in 2000 and the late 1990s, according to a National Association for Law Placement (NALP) survey. But better isn't necessarily good so keep those fingers crossed.
The survey found the acceptance rates for those positions increased from about 66 percent in 2000 to 78 percent in 2002, the most recent year for which the group has statistics for associate offers.
Increasingly, 2004 grads have been forced to consider posts that for many would not have been on the radar screen in the past: judicial clerkships, jobs in government, nonprofits and small firms.
For students entering law school this fall or for those with one or two years left before graduation, the outlook is better.

And Quite Possibly The Only Good Thing About Having Two More Years Left

Others are already picking or have picked their courses for next fall.
Maybe Southwestern is looking out for their students' best interests by doing us all a favor by allowing us to focus on exams rather than having to also deal with selecting classes for next fall. It's just a theory.

BLSA is having their 3rd Annual Spring Exam Workshop this weekend. Tomorrow, from 12:30 pm to 1:30 pm in room W611, Prof. Crim. Pro. is going over the material. At 1:45 pm - 2:45 pm, in the same room, Prof. Civ. Pro. I is going over Civ. Pro.II. There are printed materials to pick up at the printshop. So I'm guessing that they'll be going over one or two past exams. It's $5 per review session, $12 for a group of three.

I Like The New Miss USA Already
Even though she wasn't the hottest one competing last night.
Well this isn't something you see everyday. Shandi Finnessey, crowned Miss USA last night, told Reuters she would use her position to help explain America's involvement in Iraq. "What needed to be done had to be done," she said. The Associated Press chose not to report Shandi's plans with her position and nearly every other media outlet is ignoring it.

When SportsCenter Was Really Good
Brian made a reference to ESPN to support the argument that certain sportscasters do provide a unique service and it reminded me of this article on SportsCenter.

Who Got To Brief The First Case For The Class After Spring Break?
Yours truly. Bunny tried to help me out, whispering to me that I was wrong and even turning the page in my casebook for me. It didn't help me out much though because I like to listen intently to what the professor is saying out of fear that I would miss something important in a question of his. Nevertheless, the help was much appreciated. Arpineh, Bill, and Ryan said I did a good job. I thought I did an ok job. Brian and Annie said he stayed on me for quite awhile but we only had one case to read for the class so it wasn't surprising.
The case was about a personal service contract and whether a court should order specific performance as a remedy. One of the questions it turns on is whether or not the employee provides a unique service. At one point, trying to get at whether sports broadcasting by the defendant was a unique service - Prof. Contracts asked me why ABC couldn't just hire him to do the job. Now for those who know me, that's a loaded question. So as I babbled on in response, I kept thinking to myself, "Must restrain myself." I ended up saying in my babble that ABC wouldn't hire him because he has displayed in the past that he didn't know anything about sports - a good show of restraint on my part. Thankfully, Prof. Contracts can take a joke, even a bad one, and a polite audience gave me a few laughs.
After class, Brian observed that Prof. Contracts has a good memory. If I had remembered that incident, I would have come to class better prepared.

What Should One Do?
I was IMed the following
hypothetical question: say you had one lower level ticket to the third round of the Lakers playoff game. 1) would you go by yourself 2) try and sell it knowing that it is a solo ticket or 3) get your money back b/c you dont want to go alone and you dont want to hassle with selling one ticketFor clarification, that would have been the Western Conference Finals and either a game 6 or game 7.
Good Christians These Ladies
From Ananova:
Prostitutes in a Romanian town have suspended their services for Lent. Now that's a confession booth I want in on. Of course, devotion to religion is only one factor that plays into it.
The working girls in Botasani say they want to be good Christians and go to church for Easter.
The women say they will gather in groups and go to the priests to confess their sins and ask for forgiveness.
One of the girls, Luminita, told Ziarul daily: "Clients are very few these days because many of them are fasting or others keep their money for the Easter preparations. So we thought we shouldn't work this week either."Why work if there is no work? These working girls are smart. For further proof, just look at the way they plan to enforce their sacrifice as a group.
The girls are threatening to use their influence with important clients, like prosecutors or policemen, to have any prostitutes who continue to work fined.
My Next Excuse For Not Getting The Reading Assignment Done

An Email From The Crim Pro Tutor
Hi everybody:
I hope you have all enjoyed your break; we're finally in the home
stretch and finals are around the corner. Hopefully all of you have
substantially completed all of your outlines by now. So start
memorizing those outlines by reading them over and over and/or breaking
up the outline by putting individual topics on note cards; Its also time
to start analyzing all of the old exams that you could and work out all
the hypos in the book, CALI disks, etc.
Further, there is not much left to review for crim pro so I am going to
consolidate the last two tutorials into 1 tutorial. Consequently, I am
cancelling the tutorial that would have taken place this Wednesday the
14th. Thus, the last tutorial will be on Monday April 26th as
scheduled. We will review the remainder of the material and go over
test taking techniques.
See you all there!!
Enjoy the fact that you are almost finished with your 1st
year!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!GREAT JOB EVERYONE-YOU'VE
ALMOST MADE IT!!!!

Filipinos Are Crazy
I can say that because my parents are Filipino. And because they are crazy - Filipinos that is... and the parents too.
With macabre scenes of self-flagellation and live crucifixion, a normally quiet Philippines village Friday witnessed a bloody spectacle as it staged its own ``Passion of the Christ''.At least Filipinos don't crucify the Easter Bunny.
The annual Good Friday ritual at Cutud, 70 kilometres (43 miles) north of Manila, attracts thousands of tourists and Filipinos for what is seen as the ultimate atonement for Easter - despite criticism from the Catholic Church.
This year, the ritual was played out as it has been for decades with young men whipping their bloodied backs as 13 others were crucified on a hill under early afternoon heat.
On the hill where those preparing to be crucified were gathered, Romelito Vergara, 38, a street vendor from the nearby province of Pampanga, said he was hoping to repeat an earlier ceremony which cured him of polio.
``By the time I was 20 I could not walk,``he said. ``I prayed to God to help me walk again. I was crucified for the first time when I was 27 and now I am walking again.''
Nearby, carpenter Arnel Sangalong, 41, who was being crucified for the ninth time, stretched his arms out along a wooden cross, his face grimacing as the five-inch stainless steel nails were driven into his hands.
As the cross was fitted into place, nails were driven in to his feet.
Each crucifixion lasts an agonising handful of minutes, but for those like Sangalong and Vergara it is worth it to fulfill their pledge to God.
I Must Be Doing A Lot More Procrastinating Than I Thought
So I picked up the latest issue of the National Jurist and found out that conventional wisdom has the first-year law student studying three hours outside of class for every hour spent in the class room. The article also parcels out time for sleep, commuting, etc. Taking their numbers and just adjusting the hours spent in class, here's what a normal week for a Southwestern law student should be:
Hours in class: 14
Hours studying outside of class: 42
Time commuting: 10
Sleep: (6 hours per night): 42
Eating, washing, and other personal niceties and necesities: 10
Total: 118
Hours in a week: 166
That would leave the average law student at Southwestern with 48 hours - a whole weekend - of free time - where does it all go?

I'm not the only one who likes to ditch extended makeup classes. Of course, I've now used up all of my absences for Civ. Pro. or even possibly went over - if I miscalculated. So now I've got to attend the rest of the classes and come up with a really good excuse or two just in case.

Princeton Undergrad Tries To Be More Like Southwestern School Of Law
From CNN:
Faculty members and school officials are reviewing proposed changes to the university's grading system that would limit the number of A's that professors could award. The goal of the proposal made public this week is to lower the number of A's from the current 46 percent to 35 percent for undergraduate courses.I know, it's undergrad but any mention of GPAs always gets me to thinking about our school's 2.3 GPA.
In her memo, Malkiel said that 65 percent of the graduating seniors in Princeton's class of 2002 had grade-point averages of B-plus or better, and fewer than 5 percent fell below B-minus. A student with a straight C average, she said, stood second to last. [my italics]
Spring Break Day 5
Today finds me back in the library. I'm going try to understand the F.R.C.P. today using Friedenthal's hornbook of which all of the most recent editions, four of them, are only available as reserves. That means I have to recheck out the book every two hours. With four copies you would think they'd put at least one in the main stacks but with my luck it would probably be checked out. So why am I complaining again? Nevermind me and if you can't, please excuse it to upcoming final exams stress.
2004 Spring Exam Schedule
So Steve asks about my exam schedule, here it is to the best of my memory (by the way, someone remind me to check and make sure I have this right):
Criminal Procedure - May 5
Property - May 7
Civil Procedure - May 10
Torts - May 12
Contracts - May 14
That's with a reading period running from April 28 - May 4.

What Just Happened Here?
My quiet study environment has just been invaded by two rugrats. One is really trying to be nice to the other but the other one bit the other on the hand and won't share his Triple Action Web Blaster. This is not conducive to a learning environment to say the least.

From Yet Another Michigan Law Student
Stole this from here:
Population of the reading room, as of 4:08 p.m. on Friday, March 26, 2004:
1. Blonde girl in far corner, twirling her hair and playing with her glasses. Types a few words and then stares off into space for hours at a time.
2. Girl with huge laptop, drinking a Diet Coke and smiling at the screen. Probably internally chuckling over a politically-themed email forward. No books in sight.
3. Guy in polo shirt drinking out of a bike water bottle. Reading for what looks like a seminar and playing brick attack on his cell phone. Thinking about calling it a day.
4. Really diligent girl to my left who is actually doing work. Reading intently, outlining intently, not noticing the blueness of the sky or the futility of her existence. Simultaneously admirable and pathetic.
5. Dude next to me. Lots of books and highlighters, none of which have moved in three hours. Probably reading ESPN. Intimidates me anyway because the books are for one of my classes, and he looks like he's really up on things. Makes me hate myself for falling behind.
6. Girl behind me. Also really doing work and constructing beautiful, handwritten case briefs on pristine yellow legal pads. I hate her with an indescribable passion, but also want to be her friend.
7. Me. Sitting under a pile of Westlaw printouts, trying to avoid looking out the window, filling with more and more resentment as the day goes on, feeling my back and neck start to tense up to the point of paralysis, wishing I could be at a crawfish boil, even though I don't eat crawfish, and their little black googly eyes scare me a lot, and so does their poop, but I would eat them anyway if I could just leave this godforsaken place.
Get The Chemo Ready, I'm High Risk
From here:
Frequent sexual activity may reduce a man's risk of prostate cancer, according to a study in the April 7 Journal of the American Medical Association.Frequent? Just a little and I'd happilly die young from cancer.
More research may help determine how sex might be protecting some men from prostate cancer, the investigators said. The results shouldn't be used to encourage intensified sexual activity, defined as ejaculation from intercourse, masturbation or during sleep, they said.Like hell it shouldn't! My new pickup line: Hey baby, forget the ACS, there's a better way for you to help the fight against cancer ;-).
The cancer risk in men who reported more than 20 monthly ejaculations was 33 percent less than that of other men, the Harvard University study showed.Well if all I have to do is ejaculate more than 20 times in thirty days and nights, then I'm in the clear. Ain't that right Lefty?
There are several ways in which frequent ejaculations may protect against prostate cancer, the researchers said. The activity may flush out a buildup of toxins in the prostate, lessen development of tiny crystals linked to some cancers, and improve the immune system's response to cancer, Leitzmann said.
Ejaculation also may release psychological tension, quieting central nervous system activity that may contribute to prostate- cell division and cancer growth, the researchers said.
Spring Break Day 3
Working on Torts today. I'm pretty much up-to-date on all the reading for this class so I'm most likely going to do my own outline for this class even though I didn't have one - mine or anyone else's - last semester and still ended up with my best grade.
Staying Home Today
Grandma left for the Philippines last night and everyone else is going to work. Nice opportunity to stay home and hopefully be productive. Yesterday wasn't so productive. Didn't even get through a quarter of what I wanted to read. Now I have to make time that I don't have to do it.

Who Is/Was At The Library Today
The library has been fairly quiet so far during Spring Break. Today I've seen Aylin with Charles The III, Sean R. with Vinny, Danny, John, Sharokh, Scarf Girl, and Brandy with Jen M - and just now, Morrisson.
Looking For Contract Hypos?
There's a small stack of papers for Section C's Contracts class at the table by the print shop that include examples and hypos but no answers. It should still be helpful though.
Day 2 Of Spring Break
Working on Property. Yesterday I didn't actually outline for Crim. Pro. All I did was read the relevant chapters in Examples & Explanations - a good refresher - and printed out the outline that Bunny had sent me from Annie. I'm thinking about doing the same for Property by reading Understanding Property Law and then printing out APALSA's outline which is keyed to Prof. Property's class. The thing is, is that there's a lot more reading in Understanding Property - about 400 pages - that I have to do than I did in Examples & Explanations for Crim. Pro. Once again, wish me the best.

If Bunny Hasn't Already Picked Out Bridesmaid Dresses...
Taken from here comes this story:
No problem for Lynlea Jayo and Josh Traughber, a high school couple who used duct tape, thrift-store jackets and bed sheets to make their own formal wear for just $30.
Jayo and Traughber's creativity put them in the running for $2,500 scholarships. The Duck brand duct-tape company also gave $2,500 to the school as part of a national contest.
Her dress was made from an old bed sheet. She used three rolls of black and red tape on the hourglass-shaped gown with spaghetti straps.
Because of an extra layer of duct tape, Traughber's jacket weighed 14 pounds. He also made duct-tape slacks, a duct-tape T-shirt and a black-and-white checkered tie using six rolls of tape.
Living With Parents
Reasons to live at home your first year of law school, reasons not to live at home your first year.
For me, the biggest upside is that it enables me to get away from school, even if it was just for a few hours, which was usually spent sleeping, showering, and eating during the first semester. The biggest downside is that I occassionally bring home the law school stress and allow it to adversely affect my familial relationships. On balance, it's been more beneficial than not.

Good Thing I'm Procrastinating Rather Than Watching The Dodgers
Just checked out Sportsline's scoreboard and saw that the Dodgers gave up 6 runs in the top of the 5th and are now trailing the game 7-1 after 5 innings. I hope it hasn't put on a damper on things for Brian and Sean.
UPDATE: 8-2 is the final score. And by the looks of it, it looks like the Dodgers left a lot of men on base.

Maybe I Really Am Dolce & Gabbana
So Stummy took the fashion designer quiz that I took and it describes her as "snobby", "always elegantly outfitted in the latest trend", and "tend[s] to go after the rich CEO". Now go read about Stummy's Sunday and how law school students' competitive nature can emerge in a situation outside of just school and grades.
First Weekday Of Spring Break
And I'm in the library as it opens. The Dodgers open their season at 1:00 pm and college basketball's title game begins at 6:00 pm. I'm going to miss the Dodger game and most likely the basketball game as well. If the wireless is working outside, I might be able to enjoy some of the nice weather today. I love law school.

Janeane Garofalo Just Called Me Uninformed
Taken from here:
[Conservatives] are absolutely thrilled that they can take their misguided anger, and their xenophobia, and their aggressiveness, and their belligerence, and hide behind the flag and Jesus.... But unfortunately the "bullies" from the right sometimes are actually dangerous individuals. They are so filled with a combination of hate and lack of information that it makes them dangerous.Time to fan the eyes.

I have less work to do this semester, but find it much harder to get it done. I don't know if this points to the fact that I work best under pressure, or if I'm simply tired of working. Last semester I was very focused on doing my absolute best. This semester it's all I can do to show up for class with the reading done. This does not bode well for finals and I need to change my attitude. Suggestions welcome.Welcome to the club.

This Is What Law Students Discuss When Not Discussing The Law
Liable asks, "Do you ever get the sense that God invented law school in order to rid the world of yellow highlighters?"
It reminds me of a conversation that Bunny and Turtle had one morning before Civ. Pro. about how Turtle would highlight the same text twice with different color highlighters just to get the preferred highlighting color - probably orange, her personal favorite - and how difficult it was for Bunny to find the rare purple highlighter.
It also reminds me of the time when Annie said that the highlighter Bunny gave her - an orange one - looked like a vagina when viewed into.

Recently, Southwestern University's Board of Trustees reviewed the School's most pressing issues and developed goals and a budget that they believe will be adequate to maintain and enhance Southwestern's programs To maintain the highest quality educational experience was of utmost concern.
After scrutinizing Southwestern's needs, the trustees set the fiscal year 2004-2005 tuition at $950 per credit unit. This rate will be effective with the 2004 summer session.

I Love Torts
Which of the following is a reasonably foreseeable misuse of the product?
a. 11-year-old boy riding a vacuum cleaner as if it were a toy car and his penis into the casing of a vacuum cleaner and being injured by the fan blades.
b. Child injured while playing with a disposable cigarette lighter.
c. Two-year-old riding in small wooden box being pulled a riding mower. Mower hits a tree, child is thrown off, operator jumps off to pick up the child, and the mower runs over the child's leg.
Foreseeable misuse of the vacuum cleaner, cigarette lighter, or riding mower?

Yesterday
After classes, PeShawn, Rita, Bunny, Annie, Brian, and I went to The Cheesecake Factory in Beverly Hills. I had the Amaretto Milkshake and Buffalo Wings. The talk included Rita being in a bad mood, Brian liking bananas and cream more than a man should, Bunny saying inappropriate things in public, myself parroting those inappropriate things in a MUCH LOUDER voice, the service being bad, appropriate tipping, girls in our section, girls walking down Beverly Dr., old people's hearing, the meaning of irony, and Smoking Kills cigarette brand. In the end, we were well fed and shared a few good laughs.
Someone Pass This Along To Niv - That Plonker - And Then Red Card Him
Taken from here:
In soccer, spitting and swearing are serious fouls. Swearing is penalized by referees with various degrees of rigor. This site is for the instruction of referees--it's a sort of English Football Profanity Matrix complete with Venn diagrams. My friend Tony Cullen from Liverpool assures me this is not a joke of any sort, but it's hilarious. "Bitch" is worse than "shit" but they are both eclipsed by "bollocks" in terms of being offenses likely to be carded.

SBA Elections
Trini lost out on the Presidency, which makes my position as SBA Liaison all the more appealing. (Note: to the immediate left of this note is what is commonly refered to as sarcasm as another example of sarcasm: Thanks once again Stummy!) The only TVAD candidate to defeat a SW Bunch candidate was Daphne for secretary.
Yesterday
Well yesterday provided many quotes (see below). Let's see if I can put some in them in their proper perspective.
The day began with Property. Macy, for the umpteenth time, walked into class late. Our Property professor has this thing about punctuality with regards to the morning class. In what I presume to be a pre-emptive move on her part, Macy volunteered an answer but that wasn't enough to keep her from briefing the condominium cat case for the class. Prof. Property then came up with a hypo wherein she relates to her cats as if they were like her children. Bill misunderstood and took it to mean that she thought of her cats as actual people.
After Property was our three hour and forty-five minute break. Rita worked out with Trini, Annie stayed behind alone because she was slow, and the rest of us made our way back home. We all returned by 2:00 for Crim. Pro.
In Crim. Pro. we discussed the rule formerly known as Standing (Ankh). When asked about where in the Constitution a certain right could be found, Daphne responded with her quote. Also in this class, Macy raised her hand and was called on but either she forgot her question or thought it wasn't a very good one becaue she responded with, "Nevermind, I was just kidding." Because of that, Professor Crim. Pro. came back to her again and during the line of questioning she responded, "I'm just kidding", which prompted Prof. Crim. Pro.'s quote. Also, Stummy's shirt which was "a FCUK baby tee that said 'Intercourse Activities FCUK Polytechnic' with the crucial letters HUGE right over [her] chest" got attention from Prof. Crim. Pro.
