More Law School Talk

A symposium entitled Being and Becoming a Law Student found here. A worthwhile read for anyone who can find the time or is willing to procrastinate with even more reading. Here's a sampling:
I went to law school, hated virtually every minute of it, dropped out, dropped back in, and bitched and moaned like a toddler. But law school ultimately allowed me to do precisely the job I always most wanted to do: be a writer. I could not do what I do today -- cover the courts and the law -- unless I had gone to law school.

The huge irony is that if I had known back in law school how happy I would be 8 years later, I'd have had the time of my life! I would have loved my classes, taken more interesting ones, never gone to an event I hated, done even more clinical work, learned to salsa dance, and made better friends. It would have been like undergrad, but in better shoes. The reason I got stuck was because I let myself feel stuck, thinking that unless I treated law school the way everyone else treated it -- as a dark tunnel to the world of corporate law -- I was doomed.

The best thing about law school is that it really will blow open a thousand career doors for you. But you need to see them. You need to tap your way along the dark tunnel -- feeling for soft spots, and listening for folks on the other side to tap back. You need to be true to your heart; true to why you went in the first place. And you need to do whatever it takes to fight the fear and the sucking noise that will otherwise pull you into a life you may not want.

UCLA law professor Eugene Volokh on why multilateralism probably isn't a good thing.
Those voters' position would be understandable -- perhaps not terribly sound in the long term, but understandable: The deaths were caused by Aznar's policies, since if he had not supported the Americans (over the opposition of most Spaniards, as I understand), the bombings probably wouldn't have happened; therefore, let's punish Aznar, and send politicians a message to prevent this from happening again.

But if that's so, then doesn't it show that we can't allow our foreign policy to be vetoed by other nations? After all, if we agree that we may not do what we think is right and necessary for our national security if any one of England, France, Russia, or China says "veto," then our enemies can paralyze us simply by influencing one foreign country. The influence might be exerted by bribes (more here), or by threat of terrorist violence. But one way or another, an enemy that couldn't break down our resolve could still stop us from doing what needs to be done by breaking down the resolve of one of the veto-owning countries.

The foreign countries' decisions may simply be probative of their own desire not to be attacked, not of what's the morally right thing to do in the abstract, or what's the practically right thing to do for us (or even what's in the aggregate interests of humanity generally). And I don't see why we should ascribe to a view of legitimacy that makes our actions illegitimate whenever the terrorists are able to force other countries to oppose us.

More On Taiwan

The recent discussions of Annie and Brian on foreign policy leads me to link to this but don't for a moment think that I'm trying to add fuel to that fire. I'm just trying to give Brian another reason to hate the French.
China and France will hold rare joint naval exercises off the mainland's eastern coast on Tuesday, just four days before Beijing's rival, Taiwan, holds presidential elections.

China's official Xinhua news agency made no link between the exercises off Qingdao -- about 780 miles from Taiwan's northernmost point -- and the election.

But the show of military strength and solidarity signaled China's desire to isolate the self-governing island before the vote and its first-ever referendum, which Beijing views as a provocative step toward independence.

I was intially going to link to this because it has law school tips and who can't use more of those right? But now I'm linking to it because it includes this:
Curving at a 2.9 is lame, and for the first time in your life, you will probably get a "bad" grade. If I can get a C+ in Crim Pro and survive, so can you. No, I never had gotten a C before in my life. Yes, it hurt.
Well let me tell you, it hurts a hell of a lot more when the curve is a 2.3 and it's lamer too when C+ is considered a "good" grade.

I'm annoyed. At least she's kind enough to prescribe beer as a remedy to law school ills.

Did I Just Hear What I Heard?

Just saw Peter Jennings reporting from Iraq and he expressed surprise that the Iraqi's were actually grateful towards the U.S. military. I guess it's still hard for some to believe that Iraqis in general prefer U.S. military presence rather than having a crazed, bloodthirsty dicator in control.

Moot Court Round 2

Well moot court is mercifully over for me. I'll do a full write up of today's moot court round when I finish Monday's reading.

UPDATE: This is how second round went: First up was Peters, and he did fine. He didn't do as well as he did last week though. He didn't know his intro quite as well and when he asked the court whether he should give a recitation of the facts I think he was tripped up a little when the C.J. said, "It's up to you counselor. We know the facts." So it began. The justices were a little tougher on him this time around. It was a hot bench and he, like all of us there, were constantly interrupted and constantly challenged on everything we asserted. Peters' voice cracked a couple of times but it wasn't too noticeable - maybe I'm just used to it. He was no where near as persuasive with his arguments this time around as well. Also, at the end when he asked if he could conclude, the C.J. said, "You may, but briefly, in one or two sentences." Of course, Peters went on for about five sentences. As a last note on Peters' performance, he forgot to reserve time for rebuttal but in his defense - I can't believe I'm defending the guy - he wasn't reminded about it by the bailiff as opposing counsel was last week. But overall not a bad performance considering it was a very challenging court.

Next up was myself and it was bad. I mean bad. I really should have prepared more. So I stumble through my intro and sensing that I was having some trouble the court jumped in. All I remember is that I grilled on due process and I wasn't giving an ok, let alone a good, response to any of the questions. I think the C.J. was a bit annoyed with me especially when I couldn't tell him where the due process clause as it applied to the states was found in the amendments. It was very tough and I got some sympathy from one of the justices who tried to toss me a softball but I missed that one as well. This is how BS the whole thing is though. At the end, I was told that I started off great and was answering their questions well and were surprised when I said, "I'm done" when the five minute card came up.... That's right I tried to conclude halfway through. But not even conclude because I didn't say anything to the effect of, "So in conclusion..." or "For the foregoing reasons..." rather I just said, "I'm done." Of course, as I was about to walk away, much to everyone's dismay, I was told by the C.J. that I wasn't done by a "No, no you're not." So I stayed up there for five more minutes getting my ass handed to me. As I was saying though, it's all BS because, as they encourage everyone, I too was encouraged to go on. I expressed my disinterest at continuing with repeated 'I'm dones.' and was repeatedly encouraged to go on. Whatever.

The opposing counsel of Yumna and Halil did a fine job. They too were attacked repeatedly by the court and at times were caught off guard but they handled it well. Yumna was pressed on police misconduct and Halil was caught on due process like I was. Not too much detail on them because I wasn't paying too close attention seeing that I wasn't going to rebut.

Anyway, it's all over for me. Of the four of us in the room, I think Peters and Halil are going on to the third round. Yumna is going to be up north visiting her sister during third round. Yours truly, will be trying frantically to catch up on his studies.

Forget SBA, I'm Running For THE Presidency

Last Night

Tried to get into White Lotus but that didn't happen, which isn't too surprising considering the number of guys that were part of the group. After being rejected we walked down the block to Star Shoes. An interesting venue but not much to it. Really narrow is how I would describe the place. After maybe a half hour there we went back to White Lotus to get Brian's car.

Getting Brian's car was a saga in of itself. Apparently, asking the difference between regular parking and VIP parking and then selecting regular parking is a bad move. The comedic - and what we thought to be reasonable - thinking of Brian at the time he parked, was that it wasn't his job to run all the way to the farther "regular" parking lot. So regular parking it was. And so we waited and waited and Brian slipped a 20 and waited and waited and waited and waited and waited.

Once we got the car back we dropped off Arpineh and met with Armen, Annie, and Brannon at BJ's in Burbank. Perhaps the best part of the night for those of us who were there. The conversation was, as always, refreshingly funny. After BJ's, four of us, Brian, Armen, Sean, and I decided to go to Commerce to play cards rather than hitting up a strip club. Sean and Armen played hold 'em while Brian and I had another one of our girly conversations about relationships. Seriously, next time we're having a talk like that, I'm mentioning sex every third word to assure myself that I haven't lost my balls. Anyway, Sean lost, Armen won - most of it being Sean's money. We left just after 4 and I made it home just after 5.

Good thing I don't have moot court until tomorrow.

Stummy writes that this blog is proof that law students have too much time on their hands. I think she's wrong. It's not that I, or law students in general, have too much time on their hands. It's quite the opposite really. There's never enough time in the day and night to do everything a typical law student wants to do. Since understanding the law is so damn time consuming the hardest thing really is to find a balance between getting all of the school work done and enjoying a life outside of studying the law.

Anyway, all that this site is proof of is that I like to waste time that can be better spent.

At least in this way. Or at the very least I won't be alone as an insane law student cramming at the very last moment.

In a copyright battle between two British rap bands, an English court ruled that rap lyrics should for practical purposes be considered a “foreign language,” requiring expert testimony as to their interpretation.

British band Ant’ill Mob sued another band, Heartless Crew, alleging the defendant disparaged the band’s copyright for its 2001 hit song, “Burnin’,” by remixing the song using lyrics the plaintiff considered objectionable because they allegedly refer to drugs and violence. They include “shizzle my nizzle,” “mish mash man,” and “string dem up.”

However, Judge Kim Lewison said that even after playing the record at half speed and consulting the Urban Dictionary, he could not determine the meaning of the phrases without an expert witness.

The amusing predicament of three uppercrust, white, middle-aged judges trying to unravel urban slang was not lost on Judge Kim, who commented on the “faintly surreal experience of three gentlemen in horsehair wigs examining the meaning of such phrases.”

According to the Urban Dictionary (urbandictionary.com), “shizzle my nizzle” means:

Maybe It's Not So Bad To Date In Your Section

Remember that reason not to date in your section? Well apparently it was only a temporary reason. And it's not that I'm closely following that saga but the ditzy genius did use a variation of Brian's favorite phrase for coupling which made it worthy of a link.

Also from that post by the Ditzy Genius, "The last week has been busy with all the assorted law school stuff: moot court, reading and classes, interviews, and research. I've even been skipping naps. That's a sad sad thing." Sounds a lot like every 1L's life here at Southwestern University School of Law this past week. Excluding that interview part of course. Damn third-tier status!

A Virginia judge has resigned after the disclosure of racially charged remarks he wrote in an Internet chat room, including statements suggesting that blacks have a biological tendency toward violence.

Woe Is Me

Legal writing and time are my enemies, caffeine is my ally. The outcome is not in doubt but reaching that resolution is already hellish.

This Is How I'm Procrastinating At The Moment

Good to know that man still overestimates woman's ability.
The women held off the men Sunday as Tatyana Pozdnyakova used a 20 1/2-minute head start to her advantage to win the 19th annual Los Angeles Marathon.

Under a new race format called "The Challenge," Pozdnyakova, 49, of Ukraine, and 14 other women were allowed to begin before the men. She earned a $50,000 bonus prize for her winning time of 2:30:17.

David Kirui, 26, of Kenya won the men's division in 2:13:41.
That would be a 3 min. 54 sec. difference when the first woman crossed the finish line to when the first man crossed the line. That means she needed only a 16 min. and 37 sec. head start instead of the 20 min. 30 sec. that she was given.

Moot Court: First Round

Not bad at all. The opposing counsel on Miranda was asked to recite the facts and she ended up taking nearly three minutes reciting the facts from her notes before one of the judges interrupted her and made her jump into her argument. She actually did really well save for the fact that she relied way too much on her notes. She didn't make nearly enough eye contact as she kept her eyes on her notes and basically talked to them. Her partner wasn't quite as sharp and also relied on her notes too much. But she did well too because she knew her position really well. Also, both of them made the mistake of bringing too many notes to the lectern and not making eye contact with all three judges to make sure they were ready for the presentation.

Peters was damn near perfect. Didn't get fazed, answered tough questions that Prof. Sullivan said he thought he wouldn't be able to answer and did so persuasively, he was calm throughout and sounded intelligent. He did so well that one of the judges tried to trip him up at the end by asking him a statutory rape question. He didn't respond well to that but that was the only question that got him. The only real complaint from two of the judges is that he seemed to dispassionate. Sounded boring to me but he was by far the best in the room at the time.

As for myself, I was a bit more nervous than I thought I would be partially because I had to follow Peters performance. They gave me tips on how to handle questions that I don't understand - rather than asking the judge to clarify, I should have said tried to steer the discussion by saying something like, "I understand your question to mean this... and this is the answer to that question" - and what to do with my hands because apparently I was gripping the lectern too tightly. I was gripping the lectern tightly because Prof. Legal Writing had made me aware of my hand gestures.

After it was all said and done they told everyone they did well and should definitely do the third round but that's what they tell everyone. I still don't intend to do the third round.

Stummy writes, "So I'm going to say something no one would ever expect from Ms. Shopoholic. 'NO MORE SHOPPING!!' I'm quitting!" This was posted just after 2am today. Have any stores been open since? Kidding.

I'll give Stummy some credit and set the over and under at 8 days, figuring that she can't make it through next weekend without buying that really cute pair of shoes that would just complete that one outfit she has or that one really cute outfit that would complete that pair of shoes she already has. Anyone dare to take the over on this?

Sat On Death Row Today

Brandy, Danielle, Jay N., Steve C., Debbie, Jen O. Myself, Rita, Bunny, Macy, Peters, Charles, Oksana, John; that's the whole fourth row and part of the third row in Civ. Pro. II. We all got called on to answer short questions relating to trial by jury. It didn't go too bad. But that's the last time we're offering Mr. Easter Egg muffins.

Also in Civ. Pro. II, Rita brought a dozen doughnuts and a dozen mini muffins for Bunny as a sorrowful offering for all the times she missed class and Bunny was called on in place of her.

Not The One I Want Dreaming About Me

Linda just informed me that she had a dream that included several sectionmates one of whom was me. I'm not certain but I think everyone in law school has had at least one dream that included one of their fellow schoolmates. It's just one of the many ways that law school messes with your mind.

What's Going On Here?

I'm sitting in Crim. Pro. and more than a few people are missing. It's nowhere near empty but for some reason it's also the most dead I've ever seen my section during a class. Maybe it's because the due date for the appellate brief is drawing closer and closer. Or perhaps it's the fact that we have a substitute professor for today and our regular professor is going to be going over this stuff on Monday. Whatever the case may be it is absolutely dead in here. Niv is not even his usual arm waving self.

MIDDLETOWN, Connecticut (AP) -- A woman charged with causing a fatal car crash in 1999 says that she couldn't have been behind the wheel because she was performing a sex act on the driver at the time.
Ah yes, the ol' "It was my amazing blow job that killed him" defense. I wonder if a court demonstration will be in order.
Heather Specyalski, 33, was charged with second-degree manslaughter in the crash that killed businessman Neil Esposito. Prosecutors allege that she was driving Esposito's Mercedes-Benz convertible when it veered off the road and hit several trees.

But Specyalski claims that Esposito was driving, and she was performing oral sex on him at the time, said her attorney, Jeremiah Donovan. He noted that Esposito's pants were down when he was thrown from the car.

Superior Court Judge Robert L. Holzberg ruled Tuesday that Specyalski can proceed with the defense, despite objections by the prosecutor.

"A defendant has a right to offer a defense no matter how outlandish, silly or unbelievable one might think it will be," Holzberg said. He added: "No one ever told me in law school that we'd be having these kinds of conversations in open court."
The State's response?
Assistant State's Attorney Maureen Platt said the defense is flawed.

"His pants could have been down because he was mooning a car he was drag racing," Platt said. "His pants could have been down because he was urinating out of a window. His pants could have been down because he wasn't feeling well."
Hmmm.... A 33 year old man trying to impress his date by peeing out the window or mooning a would be racer. It's a winning argument.

Also Tuesday, Holzberg denied Donovan's motion to use gender as grounds to eliminate jurors. Donovan had argued that women would be biased and more likely to convict.
